Agreement to Terms

Welcome to AVIF Tools. By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use our service.

1. Description of Service

AVIF Tools provides a free online image conversion service that allows users to:

• Convert images to AVIF format (from JPG, PNG, WebP, HEIC)
• Convert AVIF images to other formats (JPG, PNG)
• View AVIF files and their EXIF metadata
• Access sample AVIF images

The service is provided "as is" without any warranties or guarantees of availability, quality, or performance.

2. User Responsibilities and Acceptable Use

2.1 Acceptable Use

You agree to use our service only for lawful purposes. You may NOT:

• Upload images that contain illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
• Upload images that infringe copyright, trademark, patent, or other intellectual property rights
• Upload images containing child sexual abuse material (CSAM) or child exploitation content
• Upload images containing personal data of others without proper authorization
• Upload malware, viruses, or any code designed to harm or exploit our service
• Use automated tools or bots to abuse or overload our service
• Attempt to gain unauthorized access to our servers or systems
• Use the service for any commercial purpose without our written consent

2.2 Content Ownership

You retain all ownership rights to the images you upload. By uploading images, you grant us a temporary, non-exclusive license to process and convert your images for the duration necessary to provide the service (maximum 1 hour).

2.3 Your Warranties

By uploading images, you represent and warrant that:

• You own the images or have all necessary rights to use them
• The images do not violate any laws or third-party rights
• The images do not contain malicious code or harmful content

3. Image Storage and Automatic Deletion

3.1 No Permanent Storage

• We do NOT provide permanent cloud storage for your images
• We do NOT create backups or copies of uploaded images
• After 1 hour, your images are permanently deleted and cannot be recovered
• It is your responsibility to download converted files within the 1-hour timeframe

3.2 Session Management

• Each upload session is assigned a unique temporary identifier
• You can access your converted files only through your session
• Sessions expire after inactivity or browser closure
• We are not responsible for lost sessions or expired download links

4. Service Limitations and Restrictions

4.1 File Size and Format Limitations

• Maximum file size per upload may be limited (typically 50-100 MB per file)
• Batch conversions may be limited to a reasonable number of files
• Only supported image formats are accepted (JPG, PNG, WebP, HEIC, AVIF)

4.2 Usage Limits

• We may implement rate limiting to prevent abuse
• Excessive use or automated access may result in temporary or permanent blocking
• We reserve the right to refuse service to anyone for any reason

4.3 Service Availability

• We do not guarantee 100% uptime or availability
• We may suspend or discontinue the service at any time without notice
• We may perform maintenance that temporarily interrupts service

5. Intellectual Property Rights

5.1 Our Content

All content on this website, including but not limited to text, graphics, logos, icons, images, audio clips, and software, is the property of Space Bits, S.L. or its content suppliers and is protected by copyright and other intellectual property laws.

5.2 Your Content

You retain all ownership rights to images you upload. We do not claim any ownership or intellectual property rights over your images.

5.3 Prohibited Uses

You may not:

• Copy, modify, or distribute our website content without permission
• Reverse engineer or decompile our conversion software
• Use our trademarks, logos, or branding without authorization
• Create derivative works based on our service

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We specifically disclaim all warranties, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy, quality, or reliability of conversion results
• Warranties that files will be free from viruses or harmful components

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPACE BITS, S.L. SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to or alteration of your transmissions or data
• Damages resulting from loss or deletion of uploaded or converted files
• Damages resulting from errors, mistakes, or inaccuracies in conversion
• Damages resulting from service interruptions or unavailability

Our total liability to you for any claims arising from use of the service shall not exceed the amount you paid to us in the past 12 months (which is €0 for free users).

8. Indemnification

You agree to indemnify, defend, and hold harmless Space Bits, S.L., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

• Your access to or use of the service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you upload to the service

9. Content Removal and Reporting Abuse

9.1 Copyright Infringement

If you believe that content uploaded to our service infringes your copyright, please contact us immediately at [email protected] with:

• Description of the copyrighted work
• URL or identifier of the infringing content (if known)
• Your contact information
• A statement that you have a good faith belief that the use is not authorized

9.2 Illegal or Harmful Content

Note: Since files are automatically deleted after 1 hour, immediate reporting is essential.

10. Third-Party Links and Services

Our service may contain links to third-party websites or services (e.g., Google Adsense). We are not responsible for:

• The content, privacy policies, or practices of third-party websites
• Any damages or losses caused by third-party services
• Advertisements displayed by third parties

Your interactions with third parties are solely between you and the third party.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on this page with an updated "Last Updated" date.

Your continued use of the service after changes constitutes acceptance of the modified Terms. If you do not agree with the changes, you must stop using the service.

12. Termination

We reserve the right to:

• Terminate or suspend your access to the service immediately, without notice, for any reason
• Remove any content you upload that violates these Terms
• Block IP addresses or users who abuse the service

Upon termination, all provisions of these Terms that should survive termination shall remain in effect, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

Any disputes arising from these Terms or use of the service shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain.
